Dear ALWTRT Member or Interested Party:

On December 19, 2002, an aerial survey was conducted over the DAM zone
which was triggered by the sighting of 8 right whales in the Jeffreys
Ledge area on November 20, 2002. No right whales were seen in this area
on the aerial survey flight. As a result of these findings, NOAA
Fisheries has determined that the action to extend the November 20th
Jeffreys Ledge DAM zone is not warranted at this time (please see
previous e-mail below). Therefore, this DAM zone and its voluntary
restrictions will expire as scheduled. However, this message is to also
provide you with advance notice that NMFS is contemplating voluntary
restrictions for lobster trap/pot and anchored gillnet gear in an area
totaling approximately 1,460 square nautical miles (nm2) (2,706 km2),
east of Cape Ann, Massachusetts, in an area called Cashes Ledges, for 15
days beginning in December and extending into January.

On December 19, 2002, 4 right whales were sighted in the proximity of
42 54' N lat. and 69 14' W long., which resulted in NMFS taking action
under the Dynamic Area Management (DAM) program to provide protection
for this aggregation of North Atlantic right whales.

NMFS anticipates that the notice announcing the DAM zone with its
voluntary restrictions will be published in the Federal Register
shortly. Once effective, these voluntary restrictions would request the
removal of all anchored gillnet gear and lobster trap/pot gear from the
area and ask that no additional gear be set in the area during the
15-day restricted period.

Coordinates for the DAM Zone beginning with the NW corner, are as
follows:

         43 13'N, 69 44'W (NW Corner)
        43 13'N, 68 50'W
        42 36'N, 68 50'W
        42 36'N, 69 44'W (SW Corner)
Please see the attached graphic of the area.

If approved, a separate e-mail message and permit holder letter will be
sent that provides the official effective date and duration of the DAM
zone.

As an ALWTRT member or interested party, NMFS appreciates your
assistance in spreading the word about the potential DAM zone and its
voluntary restrictions.

On November 20, 2002, 8 right whales were sighted in the proximity of 43 00' N lat. and 70 08' W long., which resulted in NMFS taking action under the Dynamic Area Management (DAM) program to provide protection for this aggregation of North Atlantic right whales. A DAM zone, and the temporary restrictions associated with it, expire automatically after 15 days unless extended or rescinded by subsequent publication in the Federal Register. On December 13, 2002, a subsequent survey conducted over the DAM zone found 6 right whales in the same general area as those previously sighted on November 20th. Therefore, the DAM zone trigger of 0.04 right whales per square nautical mile (1.85 km2) continues to be met. Thus, NMFS is considering issuing an extension of the voluntary requirements through publication in the Federal Register.
